The U.S. Supreme Court sided with President Donald Trump on Monday in a ruling that allows the federal government to deport alleged Venezuelan gang members under a 1798 wartime law.
The ruling overturned U.S. Judge Jame Boasberg’s March 15 order that temporarily blocked deportations under the Alien Enemies Act.
“The Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself. A GREAT DAY FOR JUSTICE IN AMERICA!” Trump wrote on Truth Social in response to the ruling.
The 5-4 ruling favored the president’s position while also allowing Venezuelans held in custody the ability to challenge their deportations. Five conservative justices sided in favor of the ruling, while Justice Amy Coney Barrett sided with three liberal justices against it.
“Regardless of whether the detainees formally request release from confinement, because their claims for relief ‘necessarily imply the invalidity’ of their confinement and removal under the AEA, their claims fall within the ‘core’ of the writ of habeas corpus and thus must be brought in habeas,” the ruling stated.
“The detainees are confined in Texas, so venue is improper in the District of Columbia. As a result, the Government is likely to succeed on the merits of this action,” it added.
The ruling may slow some deportations, but it will continue to allow migrant criminals to be deported as part of Trump’s response to illegal immigration.
U.S. Attorney General Pam Bondi celebrated the legal victory following the court’s decision.
“The Supreme Court sides with the Trump Administration on the Alien Enemies Act. Tonight’s decision is a landmark victory for the rule of law,” she posted to X on Monday.
“An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe. The Department of Justice will continue fighting in court to make America safe again,” she continued.
Homeland Security Secretary Kristi Noem also posted a statement to X following the court ruling.
“It is a bad day to be a terrorist and criminal alien in the United States of America. Today’s SCOTUS ruling is a victory for commonsense security— an activist judge cannot stop the will of the American people for a safe and secure homeland. We will continue to enforce our immigration laws and restore sanity to our immigration system by using all appropriate authorities, including the Alien Enemies Act. Thank you President @realDonaldTrump for your leadership,” Noem wrote.
