Florida judge ‘vacates’ the CDC mask mandate on airplanes: report

After years of forced mask-wearing, a federal judge has nullified the Centers for Disease Control and Prevention’s mask mandate on public transportation, including airplanes.

The Associated Press reported on Monday that U.S. District Judge Kathryn Kimball Mizelle of Tampa ruled the CDC did not sufficiently justify its mask mandate or follow rulemaking protocols.

“The Court concludes that the Mask Mandate exceeds the CDC’s statutory authority and violates the procedures required for agency rulemaking under the APA,” the ruling states.

Judge Mizelle’s decision responded to a case brought against Joe Biden by the Health Freedom Defense Fund, Inc.

“Accordingly, the Court vacates the Mandate and remands it to the CDC,” the ruling continued.
