The Trump campaign has filed a complaint with the Federal Election Commission (FEC) after Biden’s campaign treasurer allegedly signed over $91.5 million in leftover campaign funds to Kamala Harris.
According to the New York Post, Trump campaign general counsel David Warrington stated in the complaint letter, “Kamala Harris is seeking to perpetrate a $91.5 million dollar heist of Joe Biden’s leftover campaign cash — a brazen money grab that would constitute the single largest excessive contribution and biggest violation in the history of the Federal Election Campaign Act of 1971.”
He decried this action as “fraudulent” and a “mockery of our campaign finance laws.”
FEC Chair Sean Cooksey explained the rules during an interview with Laura Ingraham on Fox News, in a clip shared to X by lawyer Laura Powell.
He stated, “Here we have a situation in which a candidate is dropping out before their the formal nominee, which would usually happen – in that case under the law – is that candidate first needs to give back all their general election money.”
When questioned about this, he noted, “The FEC has a process for just these kinds of situations.”
Cooksey described how the Biden campaign could have approached the FEC and received guidance and even expedited the process.
Instead, he went on, “They just changed the paperwork on their committee, slapped a new name on it called the Harris for President committee, and it looks like they’re about to spend all of that money and deal with any enforcement matters or lawsuits later.”
He also explained that the FEC has no legal ability to prevent money from being used. Anyone who wishes to challenge this action will have to “go straight to court.”
As if that weren’t concerning enough, Cooksey shared a letter that House Democrats sent him citing his recent public statements on social media and during interviews on the subject.
They requested clarification for his comments, noting that they may create “administrative challenges and litigation concerning this issue.”
House Democrats accused him of doing so without “clarity of the law” for “partisan purposes.”
Cooksey wrote on X, “House Democrats are now trying to silence me as @FEC Chairman for raising questions about President Biden giving VP Harris all of his campaign cash.”
“All I did was quote federal regulations,” he concluded. “Why are Democrats afraid of the law?”
