Judge Cannon unseals filings revealing allegations of Jack Smith’s ‘prosecutorial conduct’

Special Counsel Jack Smith’s credibility took another hit this week over allegations of “prosecutorial misconduct” from Trump’s legal team when court documents were unsealed by Judge Aileen Cannon, casting yet another shadow over Smith’s handling of the so-called “classified documents” case.

The documents that were unsealed were from earlier this year. The filings uncovered defense arguments that “prosecutorial misconduct and violations of President Trump’s due process rights during the investigation and in grand jury proceedings” would set the grounds for dismissing the case, per Law & Crime.

The defense stated that the “politically biased NARA officials violated the agency’s regulations” as well as the Presidential Records Act by “colluding with the Biden Administration to initiate a criminal investigation of President Trump rather than simply collecting the records that President Trump had designated as Presidential Records.”

This comes as shocking reports surfaced this week that the FBI had authorized “deadly force” in their FBI raid of President Donald Trump’s Mar-a-Lago home in Palm Beach, Florida, in 2022.

The classified documents in Jack Smith’s case against Trump were taken during that infamous raid.

Judge Cannon postponed the trial date for the case indefinitely after the defense filed a motion based on allegations that Smith compromised evidence taken from Mar-a-Lago, per RSBN.

“The Special Counsel’s office disclosed to the court and the Defendants that the prosecution team has failed to maintain the integrity of the contents of at least some of the boxes obtained from Mar-A-Lago,” the defense filing argued.

Another key point in the defense’s request to dismiss the case against Trump that has been unearthed is based on their allegation that Smith went venue shopping. They scorched Smith for presenting evidence to a grand jury in Washington, D.C., despite the fact that the classified documents case is unfolding in a Florida courtroom.

On Wednesday, Judge Cannon rebuked prosecutor David Harbach in the courtroom, asking him to “calm down” during a hearing regarding defense allegations of Smith’s “prosecutorial misconduct.”

According to Politico, Harbach was irritated by Cannon’s line of questioning regarding whether he had “kept evidence of an August 2022 meeting with defense lawyer Stanley Woodward.”

“‘The Deranged One,’” Smith, badly wanted to hide his own GRAVE MISCONDUCT, but must have been prevented from doing so by an Honest and Patriotic Eyewitness,” Trump wrote on Truth Social this week.

“The Corruption of our Justice System has to be put to an end, and those responsible, including Crooked Joe Biden and those controlling him, have to be held to account. MAGA 2024!” he concluded.

With a slew of unflattering accusations unsealed against him and an indefinite postponement on the trial date for the case, Jack Smith’s credibility as the lead prosecutor in the troubled case against Trump seems paper thin.
