A new article from The Atlantic has suggested that the U.S. Constitution possibly “prohibits” President Donald Trump from running for the presidency based on Section 3 of the Fourteenth Amendment.
This newest leftist narrative comes as the president has been indicted in four cases this year. Most recently, he was indicted on four charges in a federal case related to Jan. 6 in Washington, D.C., and he was indicted just weeks later on 41 charges in an investigation in Fulton County, Georgia.
The Atlantic’s article explained their argument like this:
“This protection, embodied in the amendment’s often-overlooked Section 3, automatically excludes from future office and position of power in the United States government—and also from any equivalent office and position of power in the sovereign states and their subdivisions—any person who has taken an oath to support and defend our Constitution and thereafter rebels against that sacred charter, either through overt insurrection or by giving aid or comfort to the Constitution’s enemies.”
They also suggested that the “historically unprecedented federal and statement indictments of former President Donald Trump have prompted many to ask whether his conviction pursuant to any or all of these indictments would be either necessary or sufficient to deny him the office of presidency in 2024.”
Turning Point USA President Charlie Kirk slammed The Atlantic’s article, writing on X, “In case you thought the legal offensive against President Trump wasn’t sinister enough, left-wing law professors are now arguing that the 14th Amendment bars Trump from running for office again WITHOUT ANY criminal conviction. They’re arguing, in effect, that he is guilty until proven innocent, and they claim that any government official is empowered to pass this judgment on him.”
He called this strategy a “backup plan” in the event that the federal and state cases against Trump result in his complete exoneration. “Nobody is a bigger enemy of democratic elections or our Constitution than elite Democrats,” he added.
To that end, President Trump warned on Monday that there could be a future “RIGGING” of the presidential election in favor of “CROOKED JOE BIDEN.”
He explained, “WE HAVE A DEPARTMENT OF INJUSTICE RIGGING THE ELECTION FOR CROOKED JOE BIDEN. UNLESS IT IS QUICKLY STOPPED, ALL FUTURE ELECTIONS WILL FOLLOW THE SAME PATH!”
