‘Another frivolous 14th Amendment challenge’: Rhode Island federal court dismisses case against Trump

Trump spokesperson Steven Cheung announced that a Rhode Island federal court dismissed “another frivolous 14th Amendment” case against the 45th president on Monday, seeking to remove Trump from the state’s ballot over his alleged involvement with the Jan. 6 events.

U.S. District Court Chief Judge John J. McConnell Jr. dismissed a lawsuit filed by John Castro, a write-in Republican presidential candidate, earlier this month. 

Castro claimed that the former president allegedly violated the 14th Amendment, which should block him from running again. Additionally, Castro claimed that if Trump were to be on the ballot, he would suffer injury by taking away votes, according to The Providence Journal.

“Earlier today, a federal judge in Rhode Island dismissed yet another frivolous 14th Amendment challenge to President Trump’s ballot eligibility,” Trump’s spokesperson Steven Cheung stated in a press release. 

“Courts in Colorado, New Hampshire, Minnesota, and Michigan have all dismissed similar claims by political actors seeking to interfere with the presidential election and help the failing campaign of Cooked Joe Biden,” Cheung continued.

Judge McConnell found that Castro not only failed to show that he was a “direct and current competitor at the time that he filed his complaint” but that he also would suffer an injury if the former president remained on the ballot, according to The Providence Journal. 

However, this is not Castro’s first lawsuit against the 45th president. In fact, he has filed 27 lawsuits across the country, including in New Hampshire, challenging Trump’s alleged violation of the 14th Amendment, according to WMUR9

“President Trump remains undefeated in beating back these spurious claims. The American People have the unassailable right to vote for a candidate of their choosing at the ballot box, something that Democrats and their allies driving these cases clearly disagree with,” Cheung stated.

Castro’s last lawsuit was also dismissed in New Hampshire, as well as a similar lawsuit filed in Colorado by watchdog group Citizens for Responsibility and Ethics in Washington (CREW).

“President Trump believes the American voters, not the courts, should decide who wins next year’s elections and we urge a swift dismissal of all such remaining bogus ballot challenges,” Cheung concluded.
