In the aftermath of California’s special election, California Republicans are taking action to stop what some see as an extreme attempt to gerrymander in Democrats’ favor upon the passage of Proposition 50.
On Tuesday, Prop 50 – a measure that allows the temporary redrawing of congressional district lines before the 2026 midterm elections – passed with California voters, despite concerns that this will essentially flip several Republican-held congressional seats to the Democrats next year.
President Donald Trump called the measure “Unconstitutional” and a “Scam” ahead of the election and noted that the mandatory universal mail-in ballot system in California was “under very serious legal and criminal review.”
On Wednesday, California State Assemblyman David Tangipa (R) filed a lawsuit alongside 18 California voters and the California Republican Party, alleging that the proposition is unconstitutional based upon accusations of racial gerrymandering in the proposed redrawn maps, per The Guardian.
In a statement posted to X, Tangipa said, “We just got done suing Governor Newsom with these illegal maps, and what he’s done with Prop 50.”
In the video posted to social media, Tangipa was joined by attorney Mark Meuser, who explained the basis for the lawsuit.
“We are saying that the state of California did racial gerrymandering, contrary to your 14th and 15th Amendment rights,” he said.
Meuser alleged that the state drew 16 lines where “race was a predominant factor and the legislature did not do the necessary investigation to determine if race was a valid reason to draw the lines that they did and because the state failed to properly test past discrimination…we are arguing that the Prop 50 maps not go into effect and that the courts give us time to litigate this matter over the next couple years.”
Tangipa added, “We’re going to exhaust all options to make sure that the people of California are represented properly.”
The plaintiffs are being represented by the Dhillon Law Group.
