House Oversight Chairman James Comer, R-Ky., has released a press statement calling the Biden administration’s assertion of executive privilege over the release of the Hur tapes a Hail Mary.

During the investigation into Biden’s handling of classified files, Biden was interviewed by Special Counsel Robert Hur. Hur’s report, released in February, called Biden’s age and memory into question. Politico revealed that Hur wrote in the report that Biden was a “sympathetic, well-meaning, elderly man with a poor memory.”

According to Forbes, House Republicans issued a subpoena to the Justice Department to release the interview recording between Hur and Biden.

Now, the Biden administration has attempted to block the release of the tapes, claiming that the White House has executive privilege over them.

Comer released a statement about the White House trying to stop the release of the tapes, saying, “It’s a five-alarm fire at the White House. Clearly, President Biden and his advisors fear releasing the audio recordings of his interviews because it will again affirm to the American people that President Biden’s mental state is in decline.”

Politico reported what House Speaker Mike Johnson, R-La., also said about the move to block the tapes. “President Biden is apparently afraid for the citizens of this country and everyone to hear those tapes.” Johnson added, “The President is using all of his power to suppress their release.”

Despite claiming executive privilege over the tapes, the White House has waived them and released the interview transcripts. Comer stated, “Today’s hail Mary from the White House changes nothing for our committee.”

The House Judiciary and the Oversight and Accountability will move forward with plans to hold Attorney General Merrick Garland in contempt of court for ignoring the subpoenas for the tapes. Biden’s assertion over the tapes gives Garland some protection from prosecution, but that has not deterred Comer.
