Former advisor to President Trump, Steve Bannon, could get his contempt charge thrown out, according to a recent analysis from Gregg Jarrett, a political and legal analyst for Fox News.
Bannon was sentenced in October to 120 days in prison for failing to comply with a congressional subpoena from the Jan. 6 Committee in Washington D.C., as previously reported by RSBN.
In his article, Jarrett cites a potentially wrongfully applied “willful” defiance of a subpoena that is predicated on a “61-year-old circuit court case that was based on a Supreme Court decision that was later repudiated by the high court and overturned.”
He added, “The correct standard, as the Supreme Court has since enunciated, is that prosecutors must show that the defendant knew his actions were unlawful. But if a defendant believes his response to the subpoena is lawful, then he cannot be convicted.”
Bannon filed an appeal in his contempt conviction in November, with U.S. District Judge Carl J. Nichols opting to place Bannon’s jail sentence “on hold” while the appeal was litigated.
The possibility that his conviction might be overturned is good news for Bannon. The “War Room” host and outspoken supporter of President Trump is also facing more legal trouble amid a slate of charges brought against him by New York Attorney General Letitia James and District Attorney Alvin Bragg, per RSBN.
The charges in that case include allegations of money laundering, a scheme to defraud, and conspiracy related to his “We Build the Wal” campaign. However, Bannon is not set to head to court to face trial for those charges until November 2023.
President Donald Trump remarked positively this week on Truth Social to Jarrett’s opinion that Bannon could get his conviction sentence canned. “Good!!!” the president commented simply.
