Things may be looking up for President Trump in the so-called “classified documents” case in Florida, which is centered on allegedly “classified” documents that the FBI confiscated from the president’s home, Mar-a-Lago, in 2022 following a shocking raid on his property.
On Thursday morning, Trump appeared in a court in Fort Pierce, Florida, for a hearing on the case, which is being spearheaded by Special Counsel Jack Smith and overseen by Judge Aileen Cannon.
The president was indicted in the case in 2023 on 40 counts related to the documents that were taken from his home. Trump has made several motions to dismiss the case.
However, on Thursday, Judge Cannon heard arguments between Trump’s attorneys and Jack Smith’s prosecutors on whether the 45th president is even liable for prosecution in this matter and whether he had the unilateral capability to “declassify” documents as the chief executive officer of the U.S., per CBS News.
Journalist and political commentator Julie Kelly shared her thoughts about the arguments on X, pointing out that former Special Counsel Robert Hur’s recent House testimony on Joe Biden’s classified documents case could prove to be a sticking point for Jack Smith’s prosecution against Trump.
Via Kelly’s X statement:
“Robert Hur report and testimony is the biggest elephant in the room. The term ‘arbitrary enforcement’ used frequently by both the defense and Judge Aileen Cannon. Cannon hammered the fact no former president or vice president has been charged under Espionage Act for taking and keeping classified records including national defense information–which represents 32 counts against Trump in Jack Smith’s indictment.”
As reported by RSBN, it is important to note that the DOJ did not press charges against Joe Biden despite Hur admitting this week that they had “identified evidence that the president [Biden] willfully retained classified materials after the end of his vice presidency, when he was a private citizen.”
Kelly made a bold prediction, stating that she believed that Judge Cannon would not dismiss the case based upon the “motions debated today” but rather, “it’s very likely that she will dismiss the case based on selective prosecution, a motion still pending before her.”
While in Fort Pierce, Trump wrote on Truth Social that there was tremendous support near the courthouse as he appeared.
He shared, “Big crowds in Fort Pierce, Florida, for the Biden induced Witch Hunt against his political opponent, ME! Thank you, a great honor to have you there. Such a thing has never happened in our Country before – Strictly Third World. BUT, WE WILL MAKE AMERICA GREAT AGAIN!”
