President Donald Trump celebrated the U.S. Supreme Court’s decision to uphold freedom and block Joe Biden’s unconstitutional vaccine mandate on large employers.
“The Supreme Court has spoken, confirming what we all knew: Biden’s disastrous mandates are unconstitutional,” the 45th president wrote in a statement on Thursday afternoon.
Trump has long opposed the vaccine mandates although he encourages Americans to get vaccinated. But it could not be clearer that he vehemently opposes unconstitutional mandates of any kind.
“Biden promised to shut down the virus, not the economy but he has failed miserably on both—and mandates would have further destroyed the economy,” he continued. “We are proud of the Supreme Court for not backing down. No mandates!”
After days of deliberation, the court ruled 6-3 to overturn Biden’s vaccine requirement implemented through the Occupational Safety and Health Administration (OSHA). The rule would have required all private businesses with over 100 employees to require workers to be vaccinated against Covid-19.
Ultimately, the Supreme Court ruled that while OSHA has the authority to suggest guidance to employers, it does not have jurisdiction to create or enforce public health policy.
Justice Gorsuch stated in an unsigned opinion, “The question before us is not how to respond to the pandemic, but who holds the power to do so. The answer is clear: Under the law as it stands today, that power rests with the States and Congress, not OSHA.”
