New York Supreme Court strikes down law permitting noncitizens to vote

New York’s highest court has ruled against allowing non-citizens to vote in city elections, handing the Republican National Committee (RNC) a significant victory.

Richmond County Supreme Court Judge Ralph Porzio made clear in a ruling Monday that “there is no statutory ability for the City of New York to issue inconsistent laws permitting non-citizens to vote and exceed the authority granted to it by the New York State Constitution.”

“This Court finds that Municipal Voting Law violates the New York State Constitution, the New York State Election Law, and the Municipal Home Rule Law,” the ruling stated.

The RNC filed a lawsuit in January against New York City Mayor Eric Adams, the New York Council, and the New York Board of Elections after the state passed legislation allowing “a new class of persons called ‘municipal voters’ who are non-citizens who are either lawful permanent residents or persons authorized to work in the United States” to vote in local elections in 2023, as previously reported.

At the time, Fox News reported that RNC Chairwoman Ronna McDaniel blasted New York City Democrats, saying, “If Democrats can subvert elections this flagrantly in America’s largest city, they can do it anywhere.”

Following the court’s ruling this week, McDaniel took to Twitter to celebrate the win, writing, “This ruling is a huge victory for election integrity and the rule of law: American elections should be decided by American citizens.

“The RNC is proud to head a broad coalition in successfully challenging this unconstitutional scheme and will continue to lead the effort across the country to ensure only citizens can vote in America’s elections,” she added.

This victory signals the second win for Republicans in the state after the United States Supreme Court deemed New York’s carry restrictions unconstitutional in a 6-3 ruling last week.
