Judge cancels deportation hearing following Supreme Court decision

Judge James Boasberg has canceled an upcoming hearing after the Supreme Court sided with the Trump administration on the issue of deportations.

On Monday, the Supreme Court ruled 5-4 in favor of the Trump administration and allowed the continued deportation of alleged members of the Venezuelan Tren de Aragua gang.

President Trump praised the decision, calling it a “great day for justice in America.”

The Supreme Court ruling held the Trump administration could continue the policy of deportations under the authority of the 1798 Alien Enemies Act.

Boasberg had issued a temporary restraining order on March 15, temporarily blocking the deportations and restricting the administration’s use of the law. His decision was upheld by an appellate court before being ultimately decided by the Supreme Court.

Boasberg’s decision had been criticized as an interference in policy by an activist judge rather than proper use of judicial authority. Critics called for Boasberg to recuse himself from the case due to the apparent conflict created by his daughter’s affiliation with the left-wing group Partners for Justice.

The ruling by the Supreme Court overturns the order issued by Boasberg and grants the Trump administration’s request for temporary restraining orders to be vacated. In response to the ruling, Boasberg also canceled a previously scheduled hearing on the issue of whether the temporary restraining orders would be extended into preliminary injunctions against the actions of the Trump administration.

In authorizing the Trump administration to act under the Alien Enemies Act, the Supreme Court established due process protections for those deported under the law, including the right to appear in court and the right to receive notice of any removal proceedings.
