A Louisiana federal judge temporarily blocked the Biden administration from removing Title 42, Trump-era legislation that allows law enforcement to turn away migrants seeking asylum in the U.S. during a pandemic.
Judge Robert Summerhays, a Trump-appointed judge, agreed with the Republican-led states that petitioned the District Court to prevent Joe Biden from rescinding Title 42.
Following a discussion about the plaintiff’s desire to keep the policy, “The court announced its intent to grant the motion. The parties will confer regarding the specific terms to be contained in the Temporary Restraining Order and attempt to reach agreement,” wrote Summerhays.
Since a compendium of the hearing has not yet been made available to the public, the injunction terms are currently unknown.
Nonetheless, the ruling averts the Biden administration’s plan to end the immigration code on May 23. The sustained measure will continue to provide border enforcement the legal grounds to turn away undocumented migrants.
The mitigation is a response to a lawsuit initially filed by the states of Louisiana, Missouri, and Arizona against the Biden administration. The red-state trio argued that the border crisis is a “self-inflicted” wound created by the loose border policies of Joe Biden. Eliminating Title 42 would devolve “into an unmitigated chaos and catastrophe,” stated the complaint.

Progressives have criticized the statute, but many local and state law enforcement officers believe the Trump-enforced procedure prevents a complete invasion.
After the court’s ruling, Arizona Attorney General Mark Brnovich, R-Ariz. said, “The Biden administration cannot continue in flagrant disregard for existing laws and required administrative procedures.”
