Supreme Court Justice Clarence Thomas has given the DOJ a deadline to respond to President Donald Trump’s emergency request.

President Trump’s legal team on Tuesday requested that the nation’s highest court vacate the 11th Circuit’s stay of an order issued by District Judge Aileen Cannon, approving the appointment of a special master and temporarily enjoining the federal government from utilizing seized documents from Mar-a-Lago, RSBN reported.

According to the Supreme Court’s docket, Thomas, who oversees the 11th Circuit, ordered the DOJ to file a response to President Trump’s emergency filing by Tuesday, Oct. 11 at 5:00 p.m. ET.

In a Truth Social post, Trump heavily criticized the DOJ’s motion for a stay pending the appeal of the order.

He wrote:

“So now the FBI & Biden Department of ‘Justice’ leakers are going to spend Millions of Dollars, & vast amounts of Time & Energy, to appeal the Order on the ‘Raid of Mar-a-Lago Document Hoax,’ by a brilliant and courageous Judge whose words of wisdom rang true throughout our Nation, instead of fighting the record setting corruption and crime that is taking place right before their very eyes. They SPIED on my Campaign, lied to FISA COURT, told Facebook ‘quiet,’ preside over worst CRIME WAVE ever!!”

The Epoch Times noted that the partial stay prevented the special master, U.S. District Judge Raymond Dearie, and Trump’s legal team from accessing records labeled as classified. It also authorized the government to continue using the seized documents in their criminal investigation of the 45th president.

Nonetheless, in the Tuesday filing, Trump’s lawyers argued that the 11th Circuit Court was “effectively compromising the integrity of the well-established policy against piecemeal appellate review and ignoring the District Court’s broad discretion without justification,” per RSBN.

“This unwarranted stay should be vacated as it impairs substantially the ongoing, time-sensitive work of the Special Master. Moreover, any limit on the comprehensive and transparent review of materials seized in the extraordinary raid of a President’s home erodes public confidence in our system of justice,” the filing continued.
