President Trump to request Supreme Court rehearing on birthright citizenship ruling

President Donald Trump announced Wednesday that he plans to petition the Supreme Court to reconsider its recent ruling that invalidated his executive order aimed at ending birthright citizenship.

In a 5-4 ruling last month, the high court determined that children born within the United States to parents who are temporary residents or in the country illegally are guaranteed U.S. citizenship under the 14th Amendment, blocking Trump’s efforts to eliminate automatic citizenship.

“I will be asking for a Rehearing by the United States Supreme Court, IMMEDIATELY,” he posted on Truth Social. “This miscarriage of justice will destroy America if they don’t change their absolutely insane decision.”

Rehearings before the nation’s highest court are exceptionally rare. Under Supreme Court Rule 44, a rehearing petition must typically be submitted within 25 days of a judgment. The process is reserved for extraordinary circumstances, such as major factual or legal points that the court may have failed to consider. The court approves very few of these requests, and a rehearing can only be granted if a justice from the prevailing majority votes to allow it.

In his social media post, President Trump also alleged that advertisements promoting birthright citizenship were appearing along the U.S.-Mexico border and within Mexico.

“Signs and Billboards are being put up all over our Southern Border, and Mexico, advertising BIRTHRIGHT CITIZENSHIP, with ‘Deliveries starting at $4000,'” he wrote. “Likewise, similar signs going up all over our Country.”

He added: “Billions of Dollars will be illegally made by this SCAM, with Citizenship going to anyone willing to pay. It will be, by far, the number one way of becoming a citizen, and then the entire family will be allowed to follow. Not sustainable. NOBODY SAW THIS COMING!!! AMERICAN CITIZENSHIP IS NOT FOR SALE! In fact, that is a crime, and therefore, the Supreme Court’s ruling is wrong.”

A Manhattan federal judge ordered separately on Wednesday that $5 million in damages previously deposited by President Trump, along with nearly $800,000 in accumulated interest, be immediately released to writer E. Jean Carroll. The ruling proceeds despite the president’s pending request that the nation’s highest court review his case.

The development follows a separate legal filing earlier this week in which Trump petitioned the Supreme Court to reconsider its June 29 refusal to hear his appeal. That appeal stemmed from a New York federal jury’s verdict that found him civilly liable for sexual abuse and defamation against Carroll.
