Maine’s Superior Court handed President Donald Trump a temporary victory on Wednesday after they issued a stay on their secretary of state’s previous decision to strip the president’s name from the 2024 ballot, multiple outlets have reported.
In the order and decision issued from the court, they denied President Trump’s motion to stay proceedings and to supplement the record, but they also stayed the state’s decision from December 2023 to take Trump’s name off the ballot.
This temporary hold on that decision is pending a final decision by the U.S. Supreme Court.
According to Fox News, this is a second 14th Amendment-based case that is expected to make its way to the Supreme Court. The first major case is based out of Colorado, where their state Supreme Court ruled to take the 45th president’s name off their ballot.
Opponents of President Trump have been attempting to utilize the 14th Amendment of the U.S. Constitution to argue that he partook in an alleged “insurrection” during the events of Jan. 6, 2021, and is therefore ineligible to hold office.
However, Trump has had broad success in the courts in fending off such legal arguments. Maine and Colorado have proven to be the only sticking points on the issue thus far.
